Disclaimer and Waiver for Kingmalot.com

Kingmalot LLC ("we," "us," "our," or "Kingmalot") operates Kingmalot.com (the "Site") and organizes beer festivals and renaissance festivals (collectively, the "Events"). By accessing the Site, purchasing tickets, attending, or participating in any Event, you (the "Participant") acknowledge and agree to this Disclaimer and Waiver (the "Agreement"). This Agreement is a legally binding contract intended to provide the maximum protection to Kingmalot LLC from any and all liability arising from your involvement with the Site or Events.

If you do not agree to these terms in their entirety, do not access the Site, purchase tickets, attend, or participate in any Event. Your access, purchase, attendance, or participation constitutes your full, voluntary, and irrevocable acceptance of this Agreement, including the waiver of significant legal rights.

For minors (under 18 years of age), a parent or legal guardian must agree to this Agreement on their behalf. By allowing a minor to attend or participate, the parent or guardian represents that they have read, understood, and agreed to this Agreement, and they waive all rights on behalf of the minor as fully as if the minor were an adult.

## 1. Assumption of Risk

You understand, acknowledge, and expressly assume all risks associated with attending or participating in the Events, whether known or unknown, inherent or otherwise, including but not limited to:
- Physical hazards from renaissance festival activities, such as walking on uneven, slippery, or rugged terrain; participating in or observing interactive games, demonstrations, or performances (e.g., jousting, archery, sword fighting, fire shows, or animal interactions); climbing structures; or handling props.
- Risks related to alcohol consumption at beer festivals, including impairment, dehydration, alcohol poisoning, accidents, or interactions with intoxicated individuals.
- Crowded environments leading to pushing, shoving, crowd surges, or physical contact with other attendees, performers, vendors, or animals.
- Environmental factors, such as extreme weather (heat, cold, rain, wind), insects, allergens (e.g., pollen, dust, animal dander, food ingredients like nuts or gluten), or exposure to smoke, fire, or pyrotechnics.
- Health and safety risks, including infectious diseases (e.g., COVID-19, flu, or other communicable illnesses), injuries from slips, trips, falls, collisions, or overexertion; foodborne illnesses from vendor-provided food or beverages; or medical emergencies.
- Property damage or loss, such as theft, damage to personal belongings, or loss of valuables in crowded or outdoor settings.
- Transportation risks to, from, or within the Event venues, including parking lot incidents or shuttle services.
- Any other foreseeable or unforeseeable risks arising from the nature of outdoor festivals, live performances, or public gatherings.

You agree that these risks cannot be eliminated entirely, even with reasonable care, and that Kingmalot LLC makes no representations or warranties regarding the safety of the Events. You voluntarily choose to participate despite these risks and agree that Kingmalot LLC is not responsible for any harm, injury, illness, death, property damage, loss, or other consequences resulting therefrom.

## 2. Release of Liability

In consideration of being permitted to access the Site, purchase tickets, attend, or participate in the Events, you hereby fully and forever release, waive, discharge, and covenant not to sue Kingmalot LLC, its parent companies, subsidiaries, affiliates, officers, directors, employees, agents, contractors, subcontractors, sponsors, vendors, volunteers, insurers, and any other related parties or entities (collectively, the "Released Parties") from any and all claims, demands, actions, causes of action, suits, liabilities, damages (including compensatory, punitive, incidental, consequential, or special damages), costs, expenses (including attorney's fees and court costs), or losses of any kind, whether known or unknown, arising out of or in any way related to:
- Your access to the Site or use of its services.
- Your attendance or participation in the Events.
- Any injury, illness, disability, death, or property damage sustained by you or any third party.
- Any acts, omissions, or negligence (including ordinary negligence) by the Released Parties, but excluding only intentional misconduct or gross negligence where such exclusion is required by law.
- Event changes, delays, cancellations, or modifications due to weather, acts of God, force majeure events (e.g., pandemics, natural disasters, terrorism, government orders, or labor disputes), or any other circumstances beyond our control.
- Consumption, provision, or availability of alcohol, food, beverages, or other substances at the Events.
- Transportation, parking, or any services provided by third parties.
- Any interactions with other attendees, performers, animals, or equipment.

This release extends to all legal theories, including but not limited to negligence, breach of contract, strict liability, premises liability, product liability, tort, or statutory violations. You waive any rights under any statutes that limit waivers of unknown claims (e.g., California Civil Code § 1542 or similar laws in other jurisdictions).

## 3. Indemnification

You agree to indemnify, defend, and hold harmless the Released Parties from and against any and all claims, liabilities, damages, losses, costs, expenses (including reasonable attorney's fees and expert witness fees), or settlements arising directly or indirectly from:
- Your violation of this Agreement, any Event rules, policies, or applicable federal, state, or local laws.
- Your actions, omissions, or negligence during or related to the Events, including any harm, injury, or damage caused to third parties or property.
- Any misrepresentation or false statement made by you (e.g., regarding age, eligibility, or compliance with alcohol restrictions).
- Any claims brought by or on behalf of minors under your supervision.

This indemnification obligation is unlimited in amount and survives the termination of this Agreement, your participation in the Events, or any statute of limitations.

## 4. Medical Treatment Authorization and Release

In the event of injury, illness, or medical emergency, you authorize the Released Parties to arrange for or provide emergency medical treatment, transportation, or care at your sole expense. You agree to be fully responsible for all associated costs, including ambulance, hospital, or physician fees, and release the Released Parties from any liability related to such treatment decisions, delays, or outcomes, even if arising from negligence.

## 5. Age and Alcohol Consumption

Our Events are open to all ages, but alcohol consumption and related activities (e.g., beer tastings) are strictly restricted to individuals 21 years of age or older with valid government-issued identification. Minors under 21 must be accompanied by a parent or legal guardian at all times and are prohibited from accessing alcohol areas. By attending, you represent and warrant that you will comply with these age restrictions, consume alcohol responsibly if eligible, and supervise any minors under your care. Kingmalot LLC is not liable for any consequences arising from overconsumption, underage drinking, violations of age restrictions, parental negligence, or related incidents, including any claims for injury, illness, or legal penalties.

## 6. Photography, Recording, and Publicity Release

By attending the Events, you consent to being photographed, filmed, audio-recorded, or otherwise captured by Kingmalot LLC or its designees. You grant Kingmalot LLC an irrevocable, perpetual, worldwide, royalty-free license to use, reproduce, distribute, display, and create derivative works from such images, recordings, or likenesses for any purpose, including promotional, advertising, commercial, or archival uses, without compensation, notice, or further consent. You waive any rights of privacy, publicity, or moral rights related thereto.

## 7. No Warranties or Representations

The Site and Events are provided "as is" without any warranties, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, safety, or non-infringement. Kingmalot LLC disclaims any representations regarding the accuracy of Event information, the suitability of activities for any individual, or the absence of risks.

## 8. Force Majeure

Kingmalot LLC shall not be liable for any failure to perform obligations under this Agreement due to events beyond its reasonable control, including but not limited to acts of God, natural disasters, pandemics, epidemics, wars, terrorism, strikes, government actions, or supply chain disruptions.

## 9. Severability and Governing Law

If any provision of this Agreement is held invalid, unenforceable, or void by a court of competent jurisdiction, the remaining provisions shall remain in full force and effect to the maximum extent permitted by law. This Agreement shall be governed exclusively by the laws of the State of Florida, USA, without regard to conflict of laws principles. Any disputes, claims, or actions arising from or related to this Agreement or the Events shall be resolved exclusively in the state or federal courts located in Flagler County, Florida. You irrevocably consent to the personal jurisdiction and venue of such courts and waive any objections thereto, including forum non conveniens.

## 10. Entire Agreement and Binding Effect

This Agreement constitutes the entire understanding between you and Kingmalot LLC regarding the subject matter herein and supersedes all prior agreements. It binds you, your heirs, executors, administrators, successors, and assigns. No modifications shall be effective unless in writing and signed by an authorized representative of Kingmalot LLC.

## 11. Acknowledgment

You acknowledge that you have carefully read this entire Agreement, fully understand its terms and implications, have had the opportunity to consult with legal counsel, and agree to be bound by it voluntarily and without duress. You recognize that this Agreement involves the waiver of substantial rights, including the right to sue, and that it is a condition of your participation in the Events.
